Michael Jordan Testifies He Felt No Fear of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his drive to win and novelty within the sport motivated his effort with 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.
Financial Stakes and a Competitive Drive
The owner disclosed operational insights of his 23XI team, revealing he invested $40 million of his own funds into the Cup Series operation launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “I was a new person, I had no fear. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
Central Issue: Charter Agreements and Renewal Demands
At issue is the end of a 2016 deal where Nascar provided each team a “charter”. The concept is similar to other professional sports with separately owned franchises, like the Charlotte Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with onlookers and reporters vying for a view or a picture of the global icon.
Spearheading the Fight
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a business model Jordan said is unlawful to keep two hands on the wheel.
For Jordan and and Heather Gibbs, who preceded Jordan, are events from last September. Gibbs described a frantic and emotional six hours where the racing circuit informed teams they had to sign a charter agreement extension. The document spanned over a hundred pages detailing pay for chartered teams and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that extensive document and take the issue to court. All other teams signed the agreement.
The team owners reached out to Nascar about potential amendments or negotiations. Nascar wasn’t talking, according to his testimony.
The Ultimate Motivation: Winning
Ultimately, the resistance against what he saw as a unsustainable system was mostly about the familiar goal for Jordan: Success.
“Denny convinced me getting a third driver improved our chances to win,” he testified, sharing that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If there are 30, I have 30.”
